1. Introduction

These Terms of Service ("Terms") govern your use of Summer Engine, the AI Game Engine ("Service") provided by Summer ApS, a Danish limited liability company registered in Denmark ("Company", "we", "us", or "our").

By accessing or using Summer Engine, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.

2. Definitions

• "Service" refers to Summer Engine, including the desktop application, web platform, and related services.
• "User" or "you" refers to any individual or entity using our Service.
• "Content" refers to any code, text, data, or other materials created, uploaded, or generated through our Service.
• "AI Models" refers to the artificial intelligence models integrated into our Service.

3. Eligibility and Account Registration

You must be at least 18 years old to use our Service. By using Summer Engine, you represent that you have the legal capacity to enter into these Terms.

To access certain features, you may need to create an account. You are responsible for:

• Providing accurate and complete information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree to use Summer Engine only for lawful purposes and in accordance with these Terms. You may not:

• Use the Service for any illegal activities or to violate any laws
• Generate, create, or distribute harmful, offensive, or inappropriate content
• Attempt to reverse engineer, decompile, or extract the source code of our Service
• Use the Service to create competing products or services
• Interfere with or disrupt the Service or servers
• Share your account credentials with others
• Use the Service to generate content that infringes on intellectual property rights

5. Intellectual Property Rights

Summer Engine, including its software, algorithms, and AI models, is owned by Summer ApS and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

You retain ownership of the content you create using Summer Engine. However, you grant us a limited license to process and analyze your content to provide and improve our Service, subject to our Privacy Policy.

6. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which complies with the General Data Protection Regulation (GDPR) and Danish data protection laws.

We offer Privacy Mode, which ensures your code is never stored remotely without your explicit consent. We are working towards SOC 2 certification to further enhance our security standards.

7. Payment Terms

Summer Engine offers various subscription plans. Payment terms include:

• Subscription fees are billed in advance on a monthly or annual basis
• All prices are in USD and include applicable taxes
• You may cancel your subscription at any time
• Refunds are provided in accordance with Danish consumer protection laws
• We reserve the right to change pricing with 30 days' notice

8. Service Availability and Modifications

We strive to maintain high availability of our Service but cannot guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service with reasonable notice.

Summer Engine is currently in early access. Features and functionality may change as we continue development. Our platform builds upon established open-source technologies including the Godot game engine.

9. Termination

Either party may terminate these Terms at any time. We may suspend or terminate your access immediately if you violate these Terms. Upon termination:

• Your right to use the Service ends immediately
• We may delete your account and associated data
• You remain liable for any outstanding fees
• Provisions that should survive termination will remain in effect

10. Disclaimers and Limitation of Liability

Summer Engine is provided "as is" without warranties of any kind. To the maximum extent permitted by Danish law, we disclaim all warranties, express or implied.

Our liability is limited to the amount you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

11. Governing Law and Disputes

These Terms are governed by Danish law. Any disputes will be resolved in the courts of Denmark. We encourage resolving disputes through direct communication before pursuing legal action.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
