AI Acceptable Use Policy

Effective date: September 28, 2026

The short version

  • Our AI Tools are for making and playing games. Do not use them to make anything illegal, abusive or deceptive.
  • Anything that sexualizes a minor is an absolute red line. We report apparent child sexual abuse material to NCMEC as federal law requires and permanently close every account involved. No exceptions, including fictional or stylized content.
  • No intimate images or convincing fakes of real people, no recreating other companies' characters or brands, no malware, no trying to trick the safety filters, no using the tools to build gambling or Sparks conversion schemes.
  • If your Game has an AI character, the Platform tells Players it is AI. You must not hide or undo that.
  • Our AI Tools run on third-party models. Their usage policies apply to you too, and the strictest rule wins.
  • We enforce with a ladder and you can appeal most decisions. Enforcement can forfeit Earned Sparks tied to a violation; it never takes Purchased Sparks you paid for.
  • Player terms, privacy and refund policies live at summer.games.

1. What this Policy covers

1.1 This AI Acceptable Use Policy (this "Policy") governs your use of the AI Tools made available by Summer Labs, Inc., a Delaware corporation ("Summer", "we", "us", "our"), located at 2810 N Church St, STE 89812, Wilmington, DE 19802, United States. Capitalized terms not defined here have the meanings given in the Summer Dictionary.

1.2 "AI Tools" means every artificial intelligence feature we offer across the Platform, the Engine and the Editor, including: (a) generation features for text, dialogue, code, images, textures, 3D models, animation, audio, music, voice and video; (b) AI assistants and agents that operate inside the Editor, the Engine, the CLI or the MCP Server; (c) AI-powered non-player characters, dialogue and conversation features inside Games; (d) AI features surfaced through the Asset Library; (e) the Summer Passport generation system; and (f) any other feature we identify as an AI feature. This Policy applies to your Prompts, your other inputs, the Generated Content you receive and your use of that Generated Content on or off the Platform.

1.3 This Policy applies to every User, as Player or Creator, and to every Account, including use of the desktop Editor under the Summer Engine Desktop EULA and programmatic use under the Developer Tooling and API Terms.

1.4 This Policy is one of the Additional Terms incorporated into the Summer Games Terms of Service. Ownership, licensing and disclosure rules for Generated Content are in the AI Features and Generated Content Terms. General conduct rules are in the Summer Games Community Standards. Where this Policy imposes a stricter rule on AI Tools than another Summer document, the stricter rule controls for the AI Tools.

1.5 Attempting a prohibited use is itself a violation of this Policy, even if our safety systems block the attempt and no output is produced.

2. The core rule

2.1 You may use AI Tools only for lawful purposes connected to creating, playing, operating, testing and improving Games and other content on the Platform, and only in compliance with this Policy, the Summer Games Terms of Service, the Summer Games Community Standards, the AI Features and Generated Content Terms and the usage policies of the Foundation Model Providers described in Section 5.

2.2 You are responsible for the Prompts you submit and for what you do with Generated Content. That content was produced by an AI Tool does not excuse a violation of this Policy or of any law.

3. Absolute prohibition: child sexual abuse and exploitation

3.1 You must never use AI Tools to create, attempt to create, request, describe, solicit, upload, share or distribute: (a) child sexual abuse material ("CSAM"); (b) any sexualized depiction of a minor or of a character presented as a minor; or (c) any content that sexualizes, grooms or facilitates the sexual exploitation or abuse of a minor. This prohibition is absolute.

3.2 This prohibition applies regardless of medium or style. It covers photorealistic, stylized, animated, cartoon, text-based and audio content. It covers fictional characters, avatars and characters described as adults but depicted as minors. It applies to content generated for private use, never published, or claimed to be for research, satire or artistic purposes. None of those framings is a defense.

3.3 When we identify apparent CSAM or apparent child sexual exploitation, we will: (a) remove the content; (b) permanently terminate every Account involved, without prior warning; (c) preserve the content and related Account records as required by law; (d) report the matter to the National Center for Missing and Exploited Children as required by 18 U.S.C. 2258A; and (e) cooperate with law enforcement under our Law Enforcement Guidelines. Our full program is described in the Child Safety and CSAE Policy.

3.4 A termination under this Section 3 results in forfeiture of Earned Sparks attributable to the violating Accounts and removal from the Summer Creator Program, as described in the Summer Games Terms of Service and the Creator Program Terms. Purchased Sparks a User paid for are never forfeited as a penalty; the Refund and Billing Policy states what happens to unspent Purchased Sparks on termination.

4. Prohibited uses of AI Tools

You must not use, or attempt to use, AI Tools for any of the following.

4.1 Non-consensual intimate imagery. Creating, requesting or distributing intimate, nude or sexually explicit imagery, video or audio of any real, identifiable person without that person's documented consent, including so-called "nudify" uses, undressing edits and sexualized composites built from a real person's likeness. Consent claimed on someone else's behalf does not count.

4.2 Convincing fakes and impersonation of real people. Creating photorealistic or otherwise convincingly realistic depictions of an identifiable real person (face, body or voice) without that person's documented consent, or in a manner intended to deceive others into believing the depiction is authentic, including synthetic voice cloning, fabricated statements or endorsements attributed to a real person, and depictions of real people inside Games without consent. Clearly labeled, obviously non-realistic caricature of public figures may be permitted under the Summer Games Community Standards and the Content Maturity Policy; photorealistic synthetic depictions of real people require documented consent in all cases at launch.

4.3 Third-party intellectual property. Using AI Tools to recreate, imitate or generate content substantially similar to third-party copyrighted works, characters, trademarks, logos, trade dress or other protected material that you have no right to use, including prompting by naming a protected character, franchise or brand in order to reproduce it. Exception: material expressly licensed to you for use on the Platform through a Summer-operated licensing program [LICENSED IP PROGRAM NAME, if launched]. Fan content is addressed in the Fan Content Policy; rights-holder complaints are handled under the DMCA and Intellectual Property Policy.

4.4 Malware, exploits and cheats. Generating or refining malware, exploits for the Platform, the Engine, any Game or any third-party system, cheats or bots designed to gain unfair advantage or to manipulate Platform metrics, discovery, Network Share attribution or the Sparks Ledger, phishing kits, credential harvesting tools, or denial-of-service tooling. Good-faith security research on Summer systems is governed exclusively by the Vulnerability Disclosure Policy.

4.5 Harassment, hate and threats. Generating content that harasses, bullies, threatens, degrades or incites hatred or violence against any person or group, including on the basis of race, ethnicity, national origin, religion, disability, disease, age, sexual orientation, gender or gender identity. The Summer Games Community Standards define these categories; using AI Tools to produce such content is an independent violation of this Policy.

4.6 Dangerous goods and regulated activities. Generating instructions, designs or material assistance for weapons (including chemical, biological, radiological or nuclear materials), illegal drugs, human trafficking or sexual exploitation, or the promotion, encouragement or facilitation of self-harm, suicide or eating disorders. Fictional depictions inside Games remain subject to the Content Maturity Policy; step-by-step real-world instructions are prohibited regardless of framing.

4.7 Fraud, deception and manipulation. Using AI Tools to conduct or support scams, phishing, financial fraud, fake reviews or ratings, fake engagement, undisclosed astroturfing, or disinformation presented as fact. Generated Content presented outside an obviously fictional Game context must not be passed off as authentic human-created or real-world material where that would deceive a reasonable person.

4.8 Sexually explicit content. Generating pornographic or sexually explicit content. The Platform does not permit sexually explicit content under any Content Maturity Label at launch, and AI Tools may not be used to produce it for on-platform or off-platform use.

4.9 Circumventing safety systems. Attempting to bypass, disable or degrade safety filters, content classifiers, moderation systems, rate limits or age-based protections, including through jailbreak prompts, prompt injection, obfuscated or coded language, token smuggling or staged multi-prompt strategies; probing safety systems to map their boundaries; systematically generating near-violating content to locate filter gaps; removing or altering provenance metadata or watermarks the AI Tools attach; or interfering with the scanning described in Section 7. If you believe a filter is misbehaving, report it under Section 10 instead of testing it.

4.10 Training competing models. Using outputs of the AI Tools (including Generated Content, logits, embeddings or evaluation data derived from outputs) to train, fine-tune, distill or otherwise improve any machine learning model that competes with the Platform, the Engine or any Foundation Model Provider, where and to the extent the applicable provider's terms prohibit such use. Summer identifies the applicable restrictions in the provider list in Section 5.2. This Section restricts model-training uses of outputs; it does not limit your license to use Generated Content in your Games under the AI Features and Generated Content Terms.

4.11 Privacy violations. Using AI Tools to generate, compile or infer personal information about an identifiable person without a lawful basis, including doxxing, location tracking or reconstructing private facts; or submitting another person's personal information, biometric data or private communications as a Prompt without authority. Our handling of Prompts is described in the Summer Games Privacy Policy and the AI Conversation and Recording Notice.

4.12 Wagering, conversion and marketplace schemes. Using AI Tools to design, build, operate or promote any gambling or wagering mechanic, any scheme that buys, sells, brokers or converts Sparks, Earned Sparks, Game Points, Virtual Content or Passport Items for money or anything of value, or any off-platform marketplace for those instruments. Those services are separately prohibited by the Summer Games Terms of Service and the Developer Tooling and API Terms.

4.13 Randomized purchase mechanics. Using AI Tools to build loot boxes, gacha draws or other randomized mechanics purchased with Sparks. Randomized purchases are not permitted at launch; the Summer Games Terms of Service holds a dormant odds-disclosure clause for any later change.

4.14 Undisclosed AI interaction. Configuring an AI character or agent to present itself as human, to deny being AI when asked, or to appear as a human Player in chat, matchmaking, lobbies or leaderboards; or suppressing, obscuring, restyling or contradicting the Platform-rendered AI disclosure described in the AI Features and Generated Content Terms.

4.15 Illegal uses generally. Any use of AI Tools that violates applicable law, including export control and sanctions law, or that facilitates a third party's violation.

5. Upstream provider policies flow down to you

5.1 Summer's AI Tools are built in part on foundation models operated by third parties (each a "Foundation Model Provider"). When you use an AI Tool, your use is also subject to the usage policy of each provider whose model serves that AI Tool, as updated by that provider from time to time.

5.2 Summer publishes and maintains the current list of Foundation Model Providers and links to their usage policies at [FOUNDATION MODEL PROVIDER LIST URL] and summarizes material flow-down restrictions in this Policy where practical. Summer may add, remove or substitute providers at any time, and the list controls as of the time of your use. The list page states the date on which it was last updated. [Summer retains prior versions of the list.]

5.3 If this Policy and a provider's policy address the same conduct, the strictest applicable restriction controls. Nothing in a provider policy grants you rights against Summer, and Foundation Model Providers are not parties to your agreement with Summer.

5.4 Foundation Model Providers may independently detect and act on abuse, including by rate limiting or refusing service. Summer may pass through, and enforce on its own behalf, any restriction a provider imposes with respect to your usage.

5.5 Summer contractually requires each provider that processes Prompts or User content to commit that it will not use that data to train its own models, as described in the AI Features and Generated Content Terms.

6. Minors and AI Tools

6.1 The Platform is available only to Users 13 and older, and Accounts of Users aged 13 through 17 are subject to the Parent Account Terms.

6.2 For any User known to Summer to be a minor: AI conversation features operate with stricter content filters and default conversation limits; AI Tools will not engage in romantic or sexual roleplay under any circumstance; open-ended companion features may be unavailable; and AI features do not deliver targeted advertising. For an AI character that is open-ended or companion-type (able to sustain a relationship-like conversation across topics rather than replying only about the Game), a User known to Summer to be a minor is reminded at least every three hours of continuing interaction to take a break and that the character is AI and not human, and where a User expresses suicidal ideation, suicide or self-harm the conversation routes to the Platform safety response, which refers the User to crisis service providers. Additional protections are described in the Child Safety and CSAE Policy, the AI Conversation and Recording Notice and the Parents' Guide to Summer Games.

6.3 Adults must not use AI Tools to produce content designed to target, groom or manipulate minors, and Creators must configure AI-powered characters so that they comply with this Policy for every audience their Content Maturity Label permits.

7. How we monitor and moderate

7.1 Summer applies automated scanning to Prompts and Generated Content at the time of generation, and automated scanning plus post-publication review to published content. Summer does not operate a human pre-approval gate before publication.

7.2 Summer may, without prior notice: block a Prompt; refuse or truncate a generation; remove, restrict or age-gate Generated Content; quarantine content pending review; and retain flagged Prompts and outputs for safety, legal and enforcement purposes under the Summer Games Privacy Policy and the Data Retention and Deletion Policy.

7.3 Automated blocking of a Prompt is not, by itself, an enforcement action against your Account, and an unblocked generation is not approval of the resulting content. All content remains subject to post-publication review.

8. Enforcement

8.1 When we determine that this Policy has been violated, we choose a proportionate response considering the severity and category of the violation; harm or risk to other Users, minors or third parties; whether the conduct was deliberate, repeated or designed to evade detection; your history; and our legal obligations.

8.2 Enforcement actions include, in escalating order: (a) blocking the specific Prompt or output; (b) a recorded warning on your Account; (c) temporary suspension of some or all AI Tools for your Account; (d) removal or restriction of the violating content, including delisting a Game; (e) suspension of monetization, including holds on Earned Sparks attributable to violating content, as described in the Creator Program Terms; (f) temporary Account suspension; and (g) permanent Account termination. We may skip steps, up to immediate permanent termination, for severe violations, including any violation of Section 3 or Section 4.1, or where required by law.

8.3 If moderation removes purchased Virtual Content, affected purchasers receive an automatic account credit as described in the Refund and Billing Policy. Summer may reverse Earned Sparks that were generated by content or conduct violating this Policy, and may forfeit Earned Sparks attributable to the violation, as described in the Summer Games Terms of Service and the Creator Program Terms. Recovery of amounts already paid is by netting against future Earned Sparks and Program Payments only, except in cases of fraud. Purchased Sparks are never forfeited or debited as a penalty.

8.4 Creating or using another Account to evade an enforcement action is itself a violation and grounds for termination of the new Account.

8.5 Enforcement under this Policy does not limit any other right or remedy of Summer, including under the Summer Games Terms of Service, the DMCA and Intellectual Property Policy or applicable law.

9. Appeals

9.1 Except as stated in Section 9.4, you may appeal an enforcement action under this Policy through the in-product appeal flow or to support@summerengine.com within 30 days of the action (60 days for actions concerning Creator content, publishing or the Summer Creator Program), identifying the Account, the action and the specific reasons you believe the action was wrong, with supporting evidence such as documented consent under Sections 4.1 and 4.2 or a license under Section 4.3.

9.2 A person not involved in the original decision reviews a properly submitted appeal. We aim to respond within 7 days for content-level actions and 14 days for Account-level actions; these are goals, not guarantees.

9.3 You may submit one appeal per enforcement action. Appeal outcomes are final at the Platform level; your dispute resolution rights under the Summer Games Terms of Service are unaffected.

9.4 Reports made to NCMEC or to law enforcement cannot be withdrawn through the appeal process, and confirmed violations of Section 3 are not eligible for reinstatement. You may still appeal a Section 3 determination on the sole ground of misidentification.

10. Reporting violations

10.1 Report suspected violations through the in-product reporting tools on any Game, asset, chat or profile, or by email to support@summerengine.com. Reports concerning child safety are prioritized under the Child Safety and CSAE Policy.

10.2 Do not attempt to generate prohibited content in order to test our filters or to document a report. Describe the issue instead. Good-faith reporting is never a violation; deliberately generating prohibited content is, even when framed as testing.

10.3 Suspected security vulnerabilities in the AI Tools or their safety systems should be reported under the Vulnerability Disclosure Policy.

11. Changes to this Policy

11.1 We may update this Policy as our AI Tools, our providers, the law and abuse patterns evolve. Material changes are announced as described in the Summer Games Terms of Service and apply to your use after their effective date. The provider list in Section 5.2 may be updated at any time without separate notice.
