# Privacy Policy

## 👋 Hey, welcome to Summer!

Happy that you're checking this out. This privacy policy will explain how we handle your data while you're building amazing games with our AI Game Engine. Privacy matters a lot to us, and we know privacy matters a lot to you, so we've made this as transparent as possible.

We've tried to keep this readable - taking inspiration from companies like GitHub, Stripe, and Discord who understand that developers want straight answers, not legal jargon.

## 🔒 TLDR - Your Privacy

### Data We Collect

* Your account info (email, name)
* How you use the platform
* Performance data to fix bugs
* Code only when you choose to share it

### How AI Works

* AI providers see prompts and code snippets you send during chats
* Pro accounts can enable Privacy Mode for zero-retention with our model providers
* Free accounts: prompts and outputs may be used to improve our models — see "How we use your prompts and code" below
* We never sell your data

### Your Control

GDPR gives you full control: access your data, correct it, delete it, or take it elsewhere. We NEVER sell your data.

**Effective Date:** September 18, 2025
**Last Updated:** October 16, 2026

## 1\. Introduction

Summer Labs, Inc. ("we", "us", or "our") is committed to protecting your privacy . This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use Summer Engine, our AI-powered game development platform ("Service").

This Privacy Policy complies with the General Data Protection Regulation (GDPR) and the other data protection laws that apply to you. If you bought a subscription or credits from Summer Engine ApS (Denmark), our subsidiary, Summer Engine ApS is also a controller of the billing records for those purchases.

## 2\. Information We Collect

### 2.1 Personal Information

We collect information you provide directly to us, including:

* Account information (name, email address, password)
* Profile information and preferences
* Payment information (processed by third-party payment processors)
* Communications with our support team
* Feedback and survey responses

### 2.2 Usage Information

We automatically collect information about your use of our Service:

* Device information (operating system, browser type, device identifiers)
* Usage patterns and feature interactions
* Performance data and error logs
* IP address and general location information

### 2.3 Code and Content

When you use Summer Engine, prompts you send and code snippets included with those prompts are transmitted to our model providers to generate responses. How we and our providers handle that content depends on whether Privacy Mode is enabled on your account — see How we use your prompts and code below.

### 2.4 AI Assistants You Connect

You can connect an AI assistant, such as Claude or ChatGPT, to your Summer account through the Summer Engine connector or MCP server. You sign in on summerengine.com and choose Allow, and the assistant then acts in your account through Summer's tools. We receive:

* What the assistant sends to a Summer tool, such as your game idea, a change to your board, store page text, or a file to upload
* Which assistant app connected and which tools it used, to keep your account secure and to count usage

We do not receive your conversation with the assistant, its memory or your files, except what it sends to a Summer tool. What the tools make (boards, assets, store pages, builds) is saved in your Summer account, and the rest of this policy applies to it. The assistant's provider handles your conversation under its own privacy policy. You can disconnect an assistant at any time in [Settings, Connected apps](https://www.summerengine.com/settings/connected-apps): it can no longer renew its access, and access it already holds ends within an hour.

## 3\. How we use your prompts and code

We do not use your prompts, generated outputs, or code snippets ("Inputs and Outputs") to train our models, or permit third parties to use them for training, unless one of the following applies:

* (1) the content has been flagged for safety or security review;
* (2) you have explicitly shared the content with us as Feedback or as part of a bug report; or
* (3) you have not enabled Privacy Mode on your account.

Privacy Mode is available on all paid plans and disables training-data use for your account when turned on. Free accounts do not have access to Privacy Mode and are subject to (3) by default. You can read more about Privacy Mode at </security> and at [docs.summerengine.com/security/privacy-mode](https://docs.summerengine.com/security/privacy-mode).

## 5\. Legal Basis for Processing (GDPR)

Under GDPR, we process your personal data based on the following legal grounds:

* **Contract Performance:** To provide the Service you've subscribed to
* **Legitimate Interest:** To improve our Service, ensure security, and conduct analytics
* **Consent:** For marketing communications, Meta purchase events (Section 6.1) and optional features (where required)
* **Legal Obligation:** To comply with applicable laws and regulations

## 6\. Information Sharing and Disclosure

We do not sell your personal information. We may share your information in the following circumstances:

* **Service Providers:** With trusted third parties who assist in operating our Service. The current list is at [summerengine.com/legal/subprocessors](https://www.summerengine.com/legal/subprocessors)
* **AI Model Providers:** Prompts and code snippets you send to an AI feature go to the AI model provider that runs it, as described in Section 2.3; the providers are listed on the same page
* **Legal Requirements:** When required by law or to protect our rights
* **Business Transfers:** In connection with mergers, acquisitions, or asset sales
* **Consent:** With your explicit consent for specific purposes

## 6.1 Website analytics and ad measurement

**Google Analytics.** summerengine.com and the Studio use Google Analytics 4 from Google LLC. It uses cookies to record the pages you visit, your browser and device, and your approximate location, so that we can see how people use the site. You can block it in your browser settings or with Google's opt-out add-on at [tools.google.com/dlpage/gaoptout](https://tools.google.com/dlpage/gaoptout).

**Meta purchase events.** Some sign-up pages show a switch called "Share this purchase with Meta". If the switch is on when you buy, we send Meta Platforms a purchase event through its Conversions API: the amount and currency, a hashed (SHA-256) email address and account ID, the Meta ad click ID of the ad you came from, your browser's user agent and your IP address. We never send card details. We use these events only to measure whether our ads work. In the European Economic Area, the United Kingdom and Switzerland the switch starts off and you must turn it on; elsewhere it starts on. Your choice lasts 90 days. You can turn it off before you pay, or write to support@summerengine.com with the subject line "Privacy request" to stop future events. Meta handles the data it receives under its own privacy policy at [facebook.com/privacy/policy](https://www.facebook.com/privacy/policy). If you never see or never turn on the switch, we send Meta nothing about your purchases.

## 7\. Data Security

We implement appropriate technical and organizational measures to protect your information:

* Encryption in transit and at rest
* Regular security assessments and updates
* Access controls and authentication measures
* Privacy Mode for enhanced code protection

## 8\. Data Retention

We retain your information for as long as necessary to provide our Service and comply with legal obligations:

* **Account Data:** Until you delete your account or request deletion
* **Usage Data:** Typically 2-3 years for analytics purposes
* **Inputs and Outputs:** When Privacy Mode is enabled, our model providers do not retain your prompts or generated outputs. When Privacy Mode is not enabled, we may retain Inputs and Outputs to operate and improve our models, as described in Section 3.
* **Legal Requirements:** As required by applicable laws

## 8.1 Account deletion

Request permanent account deletion in Settings or contact support@summerengine.com. Once accepted, the request cannot be cancelled or reversed and your account access is disabled. We remove your profile, authentication credentials, and owned content through our deletion process. Processing across storage and other providers may continue after account access ends. Account deletion does not automatically erase historical usage analytics in PostHog; these remain subject to the usage-data retention described above and your applicable data protection rights. Export anything you need first; support cannot restore deleted content. Current or former team involvement, shared dependencies, and uncertain earlier ownership require support review before automatic deletion can start. Account deletion must preserve work belonging to a team; we separately assess personal information within that work. You can still contact us to request erasure of your personal information.

We retain only records still needed for a lawful purpose, such as billing, tax, fraud prevention, legal claims, and evidence of your deletion instruction. These may include a disabled account identifier, financial receipts, and the date and confirmation wording of the request. Backup copies and provider records may remain for their applicable retention periods. Copies held by other people or search engines and content belonging to collaborators are not automatically removed by account deletion. Contact us about any personal information in those copies so we can assess your request. See the [account deletion terms](https://www.summerengine.com/terms#account-deletion) for the confirmation process and consequences.

## 9\. Your Rights (GDPR)

Under GDPR, you have the following rights regarding your personal data:

* **Access:** Request a copy of your personal data
* **Rectification:** Correct inaccurate or incomplete data
* **Erasure:** Request deletion of your personal data
* **Restriction:** Limit how we process your data
* **Portability:** Receive your data in a structured format
* **Objection:** Object to processing based on legitimate interests
* **Withdraw Consent:** Withdraw consent for consent-based processing

To exercise these rights, contact us at support@summerengine.com with the subject line "Privacy request". We will respond within 30 days.

## 10\. International Data Transfers

We may transfer your data outside the European Economic Area (EEA) to provide our Service. When we do so, we ensure adequate protection through:

* Standard Contractual Clauses approved by the European Commission
* Adequacy decisions by the European Commission
* Other appropriate safeguards as required by GDPR

## 11\. Cookies and Tracking

We use cookies and similar technologies to:

* Remember your preferences and settings
* Analyze usage patterns and improve our Service
* Provide security features
* Enable certain functionality

This includes the Google Analytics cookies described in Section 6.1\. You can control cookies through your browser settings. Some features may not work properly if cookies are disabled.

## 12\. Children's Privacy

Summer Engine is not intended for children under 18\. We do not knowingly collect personal information from children under 18\. If we become aware that we have collected such information, we will delete it promptly.

## 13\. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes via email or through our Service. The updated policy will be effective when posted.

## 14\. Contact Information

**Data Controller:** Summer Labs, Inc., 2810 N Church St, STE 89812, Wilmington, DE 19802, United States
